The Property Practitioners Act 22 of 2019 (Act) came into effect on 1 February 2022. The Act obliges property practitioners to deliver a disclosure form to a seller or lessor for completion before concluding a mandate, and to a purchaser or lessee before making an offer.
The disclosure document must be signed by all relevant parties and annexed to the agreement. If not completed, signed and annexed, the agreement must be interpreted as if there were no defects or deficiencies on the property disclosed to the purchaser. Failure by a property practitioner to comply may result in [the practitioner] being held liable by an affected consumer.
At Prop Joes Inspection, we understand that the act offers much needed protection to consumers by imposing an obligation on Property Practitioners to request sellers or lessors to produce a duly completed and signed mandatory disclosure form. In retrospect, a fabric of integrity that brands our core value of quality, transparency, and trust.
